Affiliate Program Terms & Conditions

Welcome to the POS Cafe Affiliate Program! By registering as an affiliate, you agree to comply with the following terms and conditions. Please read these terms carefully to ensure a mutual understanding of rights and responsibilities in this partnership.

1. Eligibility and Acceptance into the Program

  • To participate, you must be 18 years or older and have a valid website, Shopify agency, or similar service.
  • POS Cafe reserves the right to accept or reject any application at its discretion without providing reasons.

2. Affiliate Responsibilities

  • Promotion of POS Cafe: Affiliates agree to promote POS Cafe in a positive and professional manner, using approved marketing materials and methods.
  • Compliance: Affiliates must comply with all applicable laws and regulations. Any misleading, unethical, or unauthorised practices (including spamming) are prohibited.
  • Account Information: Affiliates must maintain accurate and up-to-date information regarding their contact details and payment information in their affiliate dashboard.

3. Commission Structure

  • Rate: Affiliates earn a 15% commission on each new referred subscription to POS Cafe.
  • Payment Terms: Commissions are paid monthly, based on subscription payments received. Affiliates must reach a minimum balance of $50 before payments are issued.
  • Ongoing Commissions: Affiliates will receive ongoing commission for each month the referred customer remains subscribed.
  • Cookie Duration: The program operates with a 30-day cookie period, meaning affiliates receive credit if a customer subscribes within 30 days of clicking their link.

4. Restrictions

  • Self-Referrals: Affiliates may earn commissions on stores they build for clients.
  • Trademark Restrictions: Affiliates may not use the POS Cafe name or trademarks in a way that implies an official partnership or misleads customers.
  • Advertising Restrictions: Affiliates are prohibited from bidding on POS Cafe brand terms in search engines or running pay-per-click ads with our branded terms.

5. Tracking and Reporting

  • Unique Affiliate Link: Each affiliate will receive a unique referral link to track clicks and conversions.
  • Dashboard Access: Affiliates can view their performance, commission earnings, and other statistics through the affiliate dashboard.

6. Termination and Account Deactivation

  • Termination by POS Cafe: POS Cafe reserves the right to suspend or terminate an affiliate account at any time, particularly in cases of fraudulent activity or policy violations.
  • Termination by Affiliate: Affiliates can terminate their participation in the program at any time by providing written notice.
  • Effects of Termination: Upon termination, outstanding commissions will be forfeited if any violations are identified. Commissions earned for valid referrals prior to termination will be paid according to standard schedules.

7. Liability and Indemnification

  • Indemnification: Affiliates agree to indemnify and hold POS Cafe harmless from any liabilities arising from their participation in the affiliate program, including damages, legal fees, and claims from third parties.
  • Limitation of Liability: POS Cafe is not liable for any indirect, consequential, or incidental damages arising out of this agreement.

8. Modifications to the Terms

  • POS Cafe may update or change these terms at any time. Affiliates will be notified of significant changes via email or through the affiliate dashboard. Continued participation in the program constitutes acceptance of the revised terms.

9. Governing Law

  • This agreement shall be governed by the laws of Queensland, Australia.
